DMCA Copyright Policy

1. Copyright Infringement Notification

LearningCues respects the intellectual property rights of others and expects its users to do the same. If you believe that content available on Cue infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing our designated agent with the following information in writing:

  1. A physical or electronic signature of the copyright owner or person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, including the URL or specific location on Cue where the material appears;
  4. Your contact information: name, address, telephone number, and email address;
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Please verify that this email inbox is active before relying on it for DMCA notices. You must also register your designated agent with the U.S. Copyright Office at dmca.copyright.gov ($6 filing fee).

3. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and its former location;
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district, or if outside the United States, the jurisdiction of the courts in Florida.

4. Repeat Infringer Policy

LearningCues will terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We maintain a record of valid DMCA notices and may suspend or terminate access for users with multiple violations.

5. User-Generated Content

Community decks and custom flashcard sets are created by Cue users. We do not proactively review user-generated content for copyright compliance. If you believe that a community deck infringes your copyright, please use the “Report” button on the deck or follow the notification procedure above.
